Multiple US allies, human rights and anti-war groups, the UN and Moscow have condemned Washington’s decision to send howitzer-launched DPICM cluster bombs to Ukraine. Kiev have promised not to use the weapons against civilians, but Kiev’s record using the NATO weapons it has already speaks for itself, experts told Sputnik.

“The Ukrainian government has offered us assurances in writing on the responsible use of DPICMs, including that they will not use the rounds in civilian populated urban environments, and that they will record where they use these rounds, which will simplify later demining efforts,” under secretary of defense Colin Kahl said in a briefing Friday announcing the US decision to send cluster munitions to Kiev. 

“We will, of course, be watching how the Ukrainians use these systems. They will be reporting their usage back to us, and so we can always make judgements later if we feel like those assurances are not being met. But I’m confident that the Ukrainians will be true to their word,” Kahl added.

The Pentagon official assured that as “with every system” that Washington has already provided to Kiev to date, Ukrainian troops will be getting “coaching and mentoring” from the US associated with the use of cluster bombs.

Ukrainian Defense Minister Oleksii Reznikov echoed Kahl’s assurances in a long tweet Saturday in which he “welcomed” the US move to provide Kiev with “new liberation weapons."

Reznikov promised that Kiev would not use the cluster munitions against “the officially recognized territory of Russia,” nor urban areas, so as “to avoid the risks for the civilian populations.”

 

Empty Promises

“It’s ridiculous how many times we’ve now heard such ‘assurances’ and ‘security guarantees,’” Andrei Koshkin, a veteran Russian academic specializing in military and international affairs issues, told Sputnik.

 

“One can write about one’s intention not to use these weapons against civilians in any documents. But in practice, the conduct of military operations in Ukraine shows that the Ukrainian Armed Forces stop at nothing,” Dr. Koshkin said, pointing out that Kiev has already been condemned by the United Nations for using air-dropped Lepestok anti-personnel mines, for example.

 

“They won’t be held back by any civilians. They’ll use everything they’ve got to the fullest, without even thinking about the consequences to their own population,” the academic stressed.

Washington’s decision to hand over cluster munitions to Kiev only shows that Ukraine and its Western backers are “powerless” to change the situation on the frontlines, Russian Foreign Ministry spokeswoman Maria Zakharova said on Saturday. 

The use of this new ammunition would hardly affect the Russian military campaign but would have “dire consequences” for civilians, she noted in a statement published by the ministry.

These bombs are nothing but “yet another ‘Wunderwaffe’ [wonder weapon] Washington and Kiev are betting on, without thinking about the harsh consequences” of its employment, Zakharova said, adding that previous uses of such munitions in the Middle East and other parts of the world showed that its bomblets could stay unexploded for a long time and go off after a conflict has ended.

A spokesman for the UN secretary-general called out the use of cluster munitions on Friday, as the US prepared to announce supplying artillery shells of that type to Ukraine.

Secretary-General Antonio Guterres “supports the Convention on Cluster Munitions, which, as you know, was adopted 15 years ago. And he wants countries to abide by the terms of that convention,” his spokesman Farhan Haq told reporters at the UN headquarters in New York. 

“And so as a result, of course, he does not want there to be continued use of cluster munitions on the battlefield,” Haq concluded.

The White House has confirmed that cluster munitions will be included in the latest batch of military supplies for Ukraine. Kiev has hailed the delivery as having an “extraordinary psycho-emotional impact” on Russian troops, which the Ukrainian army has not been able to push back in a month of heavy fighting.

One of the reasons the Pentagon cited for providing the dual-purpose improved conventional munitions (DPICM) was that the US was running short of conventional 155mm artillery rounds to send to Ukraine.

Human Rights Watch and other groups have objected to the plan, noting that cluster bombs have a high rate of unexploded ordnance that continues to kill and maim civilians for years afterward.

The Convention on Cluster Munitions came into effect in August 2010, with signatories pledging to “never under any circumstances” use, develop, produce, or transfer the banned munitions, or assist, encourage and induce anyone else to do so. It has been ratified by 111 states so far – including most NATO members – though not by the US, Ukraine, or Russia.

US National Security Advisor Jake Sullivan has shrugged off claims that Washington might lose “moral authority” by providing controversial cluster bombs for Ukraine to use against Russian forces.

Sullivan addressed the issue in an NBC News interview on Sunday, defending President Joe Biden’s decision earlier this month to give Kiev munitions that the White House previously branded as criminal when they were allegedly used by Russia. Although cluster bombs are outlawed under an international treaty signed by more than 100 countries, Sullivan said neither the US nor Ukraine had ever been signatories to that pact.

“Our moral authority and Ukraine’s moral authority in this conflict comes from the fact that we are supporting a country under brutal, vicious attack by its neighbor with missiles and bombs raining down on its cities, killing its civilians, destroying its schools, its churches, its hospitals,” Sullivan told NBC host Chuck Todd. “And the idea that providing Ukraine with a weapon in order for them to be able to defend their homeland, protect their civilians is somehow a challenge to our moral authority, I find questionable.”
