British tech tycoon Mike Lynch has been cleared of fraud charges he faced in the US over the $11bn (£8.6bn) sale of his software firm to Hewlett-Packard in 2011.

A jury in San Francisco found him not guilty on all counts in a stunning victory for Mr Lynch, who had been accused of inflating the value of Autonomy, his company, ahead of its sale.

Mr Lynch, who faced more than 20 years in prison if convicted, had denied the charges and took the stand to defend himself.

In his testimony, he maintained he had focused on technology not accounting, distancing himself from other executives, including the company's former chief financial officer who was already successfully prosecuted for fraud.

"I am elated with today’s verdict and grateful to the jury for their attention to the facts over the last 10 weeks," Mr Lynch said in a statement. 

"I am looking forward to returning to the UK and getting back to what I love most: my family and innovating in my field."

University of Cambridge graduate Mr Lynch co-founded Autonomy in 1996 out of a specialist software research group called Cambridge Neurodynamics.

He led it as it grew to be one of the UK's biggest companies, winning him comparisons to Microsoft's Bill Gates and Apple's Steve Jobs. 

The company, known for software that could extract useful information from "unstructured" sources such as phone calls, emails or video, was ultimately sold to Hewlett-Packard (HP) in 2011 in a deal that ranked as the largest-ever takeover of a British technology business at the time.

Mr Lynch made £500m from the sale. Just a year later, HP wrote down the value of Autonomy by $8.8bn.

Years of legal battles followed. 

The company's chief financial officer, Sushovan Hussain, was found guilty of fraud in 2018 and later sentenced to five years in prison. 

US prosecutors brought charges against Mr Lynch in 2018, accusing him of inflating the value of the firm using backdated agreements to mislead about the company's sales; concealing the firm's loss-making business reselling hardware and intimidating or paying off people who raised concerns.

Mr Lynch, who lives in Suffolk, was eventually extradited after a UK judge ruled in favour of HP in a similar civil fraud case in 2022. HP is seeking a reported $4bn in that case.

Mr Lynch, a former UK government adviser who sat on the boards of the BBC and the British Library, had faced house arrest in the US while preparing for the trial which began in San Francisco in March. 

Prosecutors had called dozens of witnesses to the stand, including the former head of HP Leo Apotheker, who was fired shortly after the purchase was announced.

But the arguments fell flat. Mr Lynch's team pushed the argument that HP had failed to properly vet the deal and mismanaged the takeover, while he testified he was uninvolved with the transactions being described.

Judge Charles Breyer had already dismissed one count of securities fraud during the trial for lack of evidence. 

Abraham Simmons, a spokesman for the US Attorney's Office, said: "We acknowledge and respect the verdict. 

"We would like to thank the jury for its attentiveness to the evidence the government presented in this case."

As well as Mr Lynch, another former finance executive at Autonomy, Stephen Chamberlain, was also on trial. He was found not guilty.

Lawyers for Mr Lynch, Christopher Morvillo and Brian Heberlig, said in a statement that they were thrilled by the outcome, saying it reflected a "rejection of the government's profound overreach in this case". 

"This verdict closes the book on a relentless 13-year effort to pin HP's well-documented ineptitude on Dr Lynch," they said. "Thankfully, the truth has finally prevailed."

Five bodies have now been found in the wreckage of British tycoon Mike Lynch’s yacht, including those of Lynch himself and his teenage daughter Hannah, multiple media outlets reported on Wednesday.

The 56-meter-long British-flagged superyacht named ‘Bayesian’, which had 22 people onboard, had anchored just off shore near the port of Porticello when it was hit by what is believed to be a tornado or waterspout. The body of the yacht’s chef, Recaldo Thomas, was located shortly after the vessel sank.

According to reports, four bodies have been recovered while a fifth has been located but is yet to be retrieved from the wreckage. One person remains missing.

The head of Sicily’s civil protection agency, Salvatore Cocina, has reportedly confirmed that two bodies were identified as British tech billionaire Lynch and his 18-year-old daughter.

Those still unaccounted for are Morgan Stanley executive Jonathan Bloomer, his wife Judy, and New York lawyer Chris Morvillo and his wife Neda Morvillo.

Cocina told the news agency PA that the search had finished for the day and will resume on Thursday.

The vessel, which was carrying 12 crew members and ten passengers, sank in the early hours of Monday morning. Fifteen people have so far been rescued, including Lynch’s wife, who owns the ship.

Shipbuilding experts have claimed the now sunken yacht was among the “safest” available. According to The Telegraph, British investigators are likely to contact the designer of the vessel.

The incident occurred as the 59-year-old Lynch, known as ‘Britain’s Bill Gates’, was enjoying a “victory trip” to celebrate winning his US fraud trial over the £8.3 billion ($10.8 billion) sale of his software development firm Autonomy to Hewlett-Packard.

In a separate tragedy, it was reported that Lynch’s co-defendant in the trial and former vice president of finance at Autonomy, Stephen Chamberlain, was killed after being fatally struck by a car while jogging in the county of Cambridgeshire, UK, on Saturday.

Italian prosecutors have opened a manslaughter investigation over the sinking of Mike Lynch's family superyacht Bayesian off the Sicily coast on Monday.

The public prosecutor's office of Termini Imerese, headed by Ambrogio Cartosio, announced the investigation, saying the probe was not aimed at any individual person.

He said that while the yacht had been hit by a sudden meteorological event, it was "plausible" that crimes of multiple manslaughter and causing a shipwreck through negligence had been committed.

Raffaele Cammarano, another prosecutor speaking at the same news conference, said that when authorities questioned captain James Cutfield he had been "extremely cooperative".

"It's in the interests of the owners and managers of the ship to salvage it," Mr Cartosio said, adding: "They have assured their full cooperation."

Lynch was the owner of the British cybersecurity company Darktrace which, thanks to the mediation of the British government, had signed lucrative contracts to assist in the cyber warfare related to the conflict in Ukraine.

Darktrace, founded by Lynch, has long been involved in the cyber war in Ukraine. The company not only carefully analyzes and studies the tactics and groups involved in the cyber war through its blogs, but also developed a software called “Prevent-Ot” in 2023.

A software specifically designed to help Ukraine protect its critical infrastructure through the use of artificial intelligence.

Significantly, in the week following the outbreak of the conflict between February 24 and March 3, 2022, Darktrace’s share price increased by 40%.

The article reveals further details of Darktrace’s controversial activity in the so-called “vulnerability market,” which consists of exchanging information about flaws in software and security systems via the dark web. Information about these bugs is purchased, often at high prices, by actors interested in attacking rather than defending systems, suggesting that Darktrace may have been involved in offensive operations against Russia and beyond. According to an industry source cited in the article, Darktrace has been involved in this market for at least 6-7 years.

One scenario that clearly emerges is that of Darktrace’s possible involvement in the Ukrainian offensive of August 6, 2024 in the Kursk region of Russia.

This operation, the article claims, may not have been possible without a preliminary cyber attack that disabled the Russian military’s anti-drone systems and communications, allowing Ukrainian drones to penetrate Russian defenses.

British involvement in this context was also reported by The Times newspaper on August 18, 2024, which highlighted the key role of British equipment, including drones, in the new Ukrainian offensive.

On August 20, Russia’s Foreign Intelligence Service accused the UK, along with the US and Poland, of assisting Ukraine in preparing the incursion.

The UK may have played a leading role in the cyber attack that preceded the Ukrainian offensive by actively involving Darktrace as the company is deeply embedded in the British security system, with co-founders and executives boasting direct ties to national security agencies such as Mi5 and the Government Communications Headquarters (GCHQ).

Lynch’s business associates and close friends include Stephen Huxter, the company’s co-founder and former head of MI5’s electronic defense unit, Andrew France, a veteran of GCHQ, and Jim Penrose, a former member of the US National Security Agency (NSA). Former MI5 director Jonathan Evans also served for a time on Darktrace’s board.

Darktrace’s central figure, Mike Lynch, had strong institutional connections in London, having served on the BBC’s board of directors and advised former Prime Minister David Cameron on AI matters.

However, his career has been marred by legal controversies, including a fraud and false accounting charge in the US over the sale of Autonomy to Hewlett Packard.

Lynch’s death could have significant repercussions not only for Darktrace, but also for the UK’s ability to maintain a competitive edge in cybersecurity and electronic warfare, with potential consequences in crisis theaters such as Ukraine.

The links between Mike Lynch, Darktrace and the British and Ukrainian governments are increasing suspicions that the official version of the accident is a cover-up that hides a disguised extra-judicial execution of the ship and thus its sinking.

The car crash in Stretham, north of Cambridge that caused the death of Stephen Chamberlain, former vice president of finance of Autonomy, the British company founded by Mike Lynch, is increasing suspicions.

The two were business partners for many years and were tried as co-defendants for fraud in the sale of Autonomy to Hewlett-Packard for eleven billion dollars. The acquittal came last June.

In front of the reveals Agenzia Nova, the incongruities in the dynamics of the shipwreck and the car accident involving another Darktrace actor, it is mandatory to ask the question: Cui prodest?

It is difficult to answer at the moment without entering into conspiracy theories.

However, it is necessary to underline the vulnerability of NATO security in Europe considering the various incidents that have occurred in important English and German weapons factories.

Fires (the causes of which have never been disclosed) that have significantly reduced NATO’s ability to supply ammunition to Ukraine.

Lynch’s death also creates serious difficulties for NATO and Ukraine in electronic warfare with dire consequences in the ongoing conflict right now that electronic warfare would be essential to support the Ukrainian adventure of Kursk.

Lynch is not the only warmongering entrepreneur in someone’s sights.

A few months ago, German secret services foiled a plot to kill the CEO of Rheinmetall: Armin Papperger.

MEANWHILE:

 

 

Although five days have passed since the sinking of the Bayesian, not a single underwater image or video of the wreck has been released!

We only have the testimonies of military divers who state that the hull of the wreck and its mast are intact.

These testimonies are disconcerting and in conflict with that of the captain Karsten Borner of the other yacht Sir Robert Baden Powell anchored nearby Bayesian who first rescued the survivors, who stated that the mast of the Bayesian had broken in two parts.

Furthermore, the survivors have been isolated by journalists in a hotel where they cannot make statements to the operators of the press, TV and any mass media.

 

While it seems that the investigators are aprioristically oriented to place the responsibility for the disaster on the commander of the Bayesian for alleged negligence and/or failures of his professional behaviour.

A sacrifice of an innocent which would be necessary to accredit this, in my opinion, wrong narrative.

It does not seem that the investigators have taken the possibility and eventuality of sabotage into consideration at all.

Which instead seems to me inevitably necessary to rationally explain what happened.

But despite this prejudice the investigators have in fact classified all the information relating to the shipwreck, precluding third parties, journalists, from forming an independent and autonomous opinion on what happened.

When then it seems they have no doubts regarding the cause of the disaster which would be attributed in any case to the already mentioned alleged negligence and/or failures of the commander of the Bayesian.

Therefore the reason for the secrecy and the information blackout is not understood.

To protect whose interests is this secrecy taking place?

All three of these circumstances lead one to think that the investigators do not want to allow third parties to form an independent and autonomous opinion on what happened. These are the premises of a systematic cover up. 

It is not over.

Regarding my hypothesis of the inevitability and necessity of sabotage as the only possible explanation for the event that caused the sinking of the Bayesian in just one minute, an additional extraordinary element has emerged that strengthens my thesis. 

A researcher who was carrying out his own personal research on the meteorological event that involved the Bayesian sinking discovered that someone cut the weather satellite footage right in proximity to the catastrophic event, whatever it was.

Isn’t this a smoking gun placed on the suspects’ table?

Unfortunately, however, the more time passes, the more the possibilities of tampering with the wreck by the perpetrators and/or their instigators increase in order to hide the evidence of sabotage. Eventually by removing the wreck…

Again I want to point out that perhaps we will never know the truth about this shipwreck because in this case it is likely to be involved the issue of National Security and/or State or NATO secrecy.

At the end I fear that the commander of the Bayesian James Cutfield will end up being the innocent trial victim. The scapegoat for an hybrid war secret too unspeakable to be revealed in a climate of war propaganda and misinformation.

Finally let me list some possible instigators of the disaster:

  • the Iranians
  • anyone who want to rig the election for the next President of the United States  (please remember that Lynch through his companies was a top specialist in processing and controlling strategically important data and information)

Michael Richard Lynch OBE DL FRS FREng (16 June 1965 – c.19 August 2024) was a British technology entrepreneur who co-founded Autonomy Corporation, Invoke Capital and Darktrace. He had various other roles, including in an advisory capacity.

Following an undergraduate degree, a doctorate and post-doctoral research at the University of Cambridge, Lynch applied his research in machine learning to set up software companies and become a major figure in Silicon Fen. He was described in the press as the British equivalent of the American businessman Bill Gates, with an estimated worth of £852 million in 2023. 

The sale of Autonomy to Hewlett-Packard in 2011 led to accusations of fraud and resulted in civil litigation in the UK in 2019. The case was decided largely in favour of Hewlett-Packard. In 2023, Lynch was extradited to the United States to face criminal charges. He went on trial in San Francisco in March 2024 and in June was found not guilty on all counts. In August 2024, he celebrated his acquittal on his family's superyacht, Bayesian, which capsized and sank in a storm off the coast of Sicily on 19 August. ROME: Italian prosecutors will investigate the captain of the super yacht belonging to British tech magnate Mike Lynch that sank off Sicily last week during an intense storm, killing Lynch and six other people, Italian media reported yesterday.

Being placed under investigation in Italy does not imply guilt and does not mean formal charges will necessarily follow.

James Cutfield, a 51-year-old New Zealand national, is being investigated for manslaughter and shipwreck, it was reported. Magistrates spoke to Cutfield on Sunday for the second time in a week, questioning him for more than two hours. Prosecutors may also investigate a surviving crew member who was on duty when the storm hit.

The British-flagged Bayesian, a 56-metre super yacht, was carrying 22 people when it sank last Monday within minutes of being hit by a pre-dawn storm while anchored off the town of Porticello.

Fifteen people survived, including Lynch’s wife, whose company owned the Bayesian. Lynch’s 18-year-old daughter, Hannah, was among those who died.

While the yacht had been hit by a sudden meteorological event, it was plausible that crimes of multiple manslaughter and causing a shipwreck through negligence had been committed, the head of the public prosecutor’s office of Termini Imerese, Ambrogio Cartosio, said at the weekend.

Maritime law gives a captain full responsibility for the ship, crew, and all on board.

Cutfield and his eight surviving crew members have made no public comment yet on the disaster.

‘‘The Bayesian was built to go to sea in any weather’’, Franco Romani, a nautical architect who was part of the team that designed the vessel, said in an interview published in La Stampa newspaper yesterday.

He said the yacht could have taken on water that came through a side hatch that had not been closed.

Romani said the crew had underestimated the bad weather and that they should have made sure that all openings had been shut and the anchor raised before the storm hit the boat. Reuters
