Assaults on free speech go into hyperdrive after Charlie Kirk killing

 

Jimmy Kimmel  was fired after President Trump’s FCC  threatened ABC when the late night comic suggested that Kirk’s killer was a Trumper. I personally dislike Kimmel, but this is about as naked a government assault on free expression as you could possibly imagine.

Palestinian activist Mahmoud Khalil has been  ordered deported to Syria or Algeria after the Trump administration targeted him for political speech critical of Israel.

Trump has  brokered a deal allowing TikTok to be purchased by a consortium that includes his billionaire buddies Larry Ellison and Marc Andreesen. US officials  have acknowledged that Washington’s push to grab control of TikTok was because of the opposition to the Gaza holocaust that was circulating on the platform.

Oracle co-founder Ellison is a  fanatical Zionist oligarch who has  expressed support for the idea of a massive surveillance network to control all of society, and his son David just  purchased Paramount, which owns CBS News. The younger Ellison has reportedly installed pro-Israel propagandist Bari Weiss to a senior leadership position within the network.

Trump says he has asked Attorney-General Pam Bondi to look into bringing “ criminal RICO charges” against  Code Pink activists who chanted anti-genocide slogans at him while he was dining at a restaurant. Like pro-Palestine demonstrators are mafia kingpins or something.

Bondi  said during a podcast that the Trump administration is going to start prosecuting “hate speech” against conservatives, alleging that such speech was responsible for Kirk’s assassination.

When asked by the press about Bondi’s comments, Trump  said “We’ll probably go after people like you, because you treat me so unfairly. It’s hate. You have a lot of hate in your heart. Maybe I’ll come after ABC.” Again, ABC was the network Jimmy Kimmel was fired from.

Trump henchman Stephen Miller  said on a podcast that the White House is going to start targeting leftist “terrorist networks”, claiming on no basis whatsoever that Kirk’s assassination was the fault of a “vast domestic terror movement” which foments the kind of violence which led to Kirk’s death. Trump himself  said that “a lot of people that you would traditionally say are on the left … [are] already under investigation”, and that he  plans to designate Antifa as a terrorist organisation.

Vice-President J.D. Vance has publicly been encouraging Trump supporters to try to get ordinary members of the public fired for saying mean things about Kirk, saying, “When you see someone celebrating Charlie’s murder, call them out, and hell, call their employer. We don’t believe in political violence, but we do believe in civility.”

Trump’s Truth Social account recently  shared a video calling for state censorship of media outlets and online influencers who share “propaganda”, falsely framing this authoritarian notion as a reboot of the Smith-Mundt Act and suggesting that it should be called the “Charlie Kirk Act”.

The empire managers are always seeking excuses to suppress free speech, crush the left and stomp out opposition to Zionism and the US war machine. They’ll use any chance they get to advance these goals, which are all ultimately about expanding power and control.

Many pre-existing agendas are being shoved forward by those in power, as always happens when emotions run hot over a traumatic event. I’ve said it many times before and I’ll surely say it many times again: it’s precisely when we are most tempted to abandon rationality and play along with the emotionality of the moment that we need to be thinking most clearly and critically.

By the authority vested in me as President by the Constitution and the laws of the United States of America, and section 301 of title 3, United States Code, it is hereby ordered as follows:

     Section 1.  Purpose.  The First Amendment to the United States Constitution, an amendment essential to the success of our Republic, enshrines the right of the American people to speak freely in the public square without Government interference.  Over the last 4 years, the previous administration trampled free speech rights by censoring Americans’ speech on online platforms, often by exerting substantial coercive pressure on third parties, such as social media companies, to moderate, deplatform, or otherwise suppress speech that the Federal Government did not approve.  Under the guise of combatting “misinformation,” “disinformation,” and “malinformation,” the Federal Government infringed on the constitutionally protected speech rights of American citizens across the United States in a manner that advanced the Government’s preferred narrative about significant matters of public debate.  Government censorship of speech is intolerable in a free society.  

     Sec. 2.  Policy.  It is the policy of the United States to:       (a)  secure the right of the American people to engage in constitutionally protected speech;

     (b)  ensure that no Federal Government officer, employee, or agent engages in or facilitates any conduct that would unconstitutionally abridge the free speech of any American citizen;

     (c)  ensure that no taxpayer resources are used to engage in or facilitate any conduct that would unconstitutionally abridge the free speech of any American citizen; and

     (d)  identify and take appropriate action to correct past misconduct by the Federal Government related to censorship of protected speech.

     Sec. 3.  Ending Censorship of Protected Speech.  (a)  No Federal department, agency, entity, officer, employee, or agent may act or use any Federal resources in a manner contrary to section 2 of this order.

     (b)  The Attorney General, in consultation with the heads of executive departments and agencies, shall investigate the activities of the Federal Government over the last 4 years that are inconsistent with the purposes and policies of this order and prepare a report to be submitted to the President, through the Deputy Chief of Staff for Policy, with recommendations for appropriate remedial actions to be taken based on the findings of the report.

     Sec. 4.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:

(i)   the authority granted by law to an executive department or agency, or the head thereof; or

(ii)   the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

     (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

     (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Weaponization Committee Exposes the Biden White House Censorship Regime in New Report

WASHINGTON, D.C. – Today, the House Judiciary Committee and its Select Subcommittee on the Weaponization of the Federal Government released an interim staff report titled, "The Censorship-Industrial Complex: How Top Biden White House Officials Coerced Big Tech to Censor Americans, True Information, and Critics of the Biden Administration." The report details the monthslong campaign by the Biden White House to coerce large companies, namely Facebook, Google, and Amazon, to censor books, videos, posts, and other content online. By the end of 2021, Facebook, YouTube, and Amazon changed their content moderation policies in ways that were directly responsive to criticism from the Biden Administration.

After reviewing tens of thousands of emails and nonpublic documents between the Biden White House and Big Tech, the Committee's report reveals:  

 

• Big Tech changed their content moderation policies because of the Biden White House 

• The Biden White House's censorship targeted true information, satire, and other content that did not violate the platforms' policies 

• The Biden White House's censorship campaign had a chilling effect on other speech 

• The White House had leverage because the companies had other policy concerns involving the Biden Administration 

• The Biden White House pushed censorship of books, not just social media

 

While the Biden White House's pressure campaign largely succeeded, its effects were devastating. By suppressing free speech and intentionally distorting public debate in the modern town square, ideas and policies were no longer fairly tested and debated on their merits. 

The First Amendment prohibits the government from "abridging the freedom of speech." Thus, "any law or government policy that reduces that freedom on the [social media] platforms . . . violates the First Amendment." To inform potential legislation, the Committee and Select Subcommittee have been investigating the Executive Branch's collusion with third party intermediaries to censor speech. The Committee and Select Subcommittee have uncovered other serious violations of the First Amendment throughout the Executive Branch during the Biden Administration.

The Economist Cites A Study By Literal Antifa To Talk About ‘Right-Wing Violence’

Since the horrific assassination of Charlie Kirk, legacy media have gone above and beyond to tank what little credibility they had with the broader American public. And that statement could not be more applicable to The Economist. 

Late last week, the U.K.-based outlet ran a story attempting to run cover for the spate of leftist-led violence wreaking havoc across the United States. To accomplish this feat, the piece highlighted several “studies and datasets … largely compiled by researchers whom s[k]eptical conservatives would probably dismiss as biased” to “suggest that the killing of Mr Kirk is not representative of broader trends.”

 

And whom, may you wonder, is among these esteemed “researchers” cited by The Economist? None other than the University of Cincinnati’s Michael Loadenthal, a radical leftist who previously disclosed his affiliation with the left-wing militant group Antifa

As Eoin Lenihan previously wrote in these pages, “In 2021, Loadenthal spoke at a ‘White Nationalism Workshop‘ and an ‘Extremism, Rhetoric and Democratic Precarity‘ roundtable at [Dayton] University’s ‘Social Practice Of Human Rights Conference.'” It was during the former event, Lenihan noted, that “Loadenthal introduced himself by stating that he is militant Antifa; he then continued his talk by teaching audience members how to securely dox people to their employers.”

“Throughout the talk he framed his work in explicitly ‘antifascist’ terms, explaining how he employs ‘antifascist intelligence‘ to dox individuals online and in real life,” Lenihan wrote. 

In its article, The Economist noted Loadenthal’s work on the “Prosecution Project,” which purportedly “analyses felony criminal cases involving political violence to see which ideologies are most common,” according to the outlet. The project’s data ostensibly “show[s] that extremists on both left and right commit violence, although more incidents appear to come from right-leaning attackers.”

As 1776 Project PAC founder Ryan James Girdusky recently observed, however, the Prosecution Project’s “data” appears highly questionable (if not flat out inaccurate), as it “ties in people with no political affiliations to conservatives or political motives to make the case that right-wingers are responsible for an overwhelming number of politically motivated crimes.”

“You know what wasn’t counted as politically motivated violence… almost any of the arson, rapes, and murders from BLM and Antifa activists during the 2020 summer of love. Burning the police station in Minneapolis, the rape and assaults in the CHAZ zone, or the six deaths associated with the trans cult, the Zizians,” Girdusky wrote. “Left-wing violence isn’t violence, while anyone can be considered rightwing violence, even if it isn’t right-wing or particularly violent.”

Cardiologist Peter MacDonald is on forced leave from his job of saving lives. He asked questions about Israel in a public forum and has been censored and condemned by St Vincent’s Hospital. Wendy Bacon with the story.

 

Dr Peter MacDonald helped pioneer transplant surgery in Australia and is a senior specialist in the Transplant Unit at St Vincent’s Hospital and co-head of the Transplantation Research Laboratory at its partner organisation, the Victor Chang Cardiac Research Institute.

He developed the ‘Heart in the Box’ that enables transplants using the hearts of brain-dead patients. He is a partner in a research program to develop treatments using the venom of funnel web spiders that could save the lives of many who have heart attacks. For 19 years, Professor Macdonald has visited the Condobolin Aboriginal Medical Centre every month.

But for two weeks now, his work to save lives has halted. He is on what is called ‘unspecified leave’. Macdonald declined to be interviewed for this article.

This week, the NSW Council for Civil Liberties expressed its concern that a person “in their private capacity, asked a question about an intelligence agency and has subsequently,” and

been targeted, censored and publicly condemned by their employer.

Macdonald would still be hard at work if not for the actions of a small group of pro-Israeli health workers called the Alliance Against Antisemitism in Healthcare (AAAHC) who have demanded Macdonald be “disciplined or terminated” following a 30 second long contribution to a Palestine Justice Movement Sydney (PJMS) forum where he identified himself as a cardiologist but did not mention his employing institutions.

Academic Alliance against Antisemitism

AAAHC is a branch of the Australian Academic Alliance Against Antisemitism (5A) that lobbied for the imposition of the Code of Conduct, which derailed the Bendigo Writers’ Festival last month by triggering authors to resign in protest. It promotes the IHRA definition of antisemitism and has asserted that it is antisemitic even to accuse Israel of being an ‘apartheid state’, a description widely adopted by human rights organisations and international lawyers.

The PJMS forum was organised to discuss the Australian Combat Antisemitism Mayors’ Summit that was held in early September on the Gold Coast. The panellists included Greens activist and lawyer Hannah Thomas, who is suing the State of NSW after police punched her in the eye at a pro-Palestinian protest; criminal barrister and podcaster Nick Hanna, and MWM’s reporters Yaakov Aharon and this author, who published stories on the Summit together.

Macdonald’s question referred to the PM Anthony Albanese’s announcement that ASIO had informed him that it had received intelligence suggesting that the Iranian Revolutionary Guard Corps (IRGC) organised antisemitic attacks in Australia. ASIO specifically referred to the two attacks on the Adass Synagogue in Melbourne, Lewis’s Continental Kitchen in Sydney, and potentially further attacks.

While Albanese said ASIO had intelligence suggesting IRGC’s involvement in these attacks, he did not provide details of what evidence had been gathered, nor did he state what  intelligence had been gathered directly by ASIO. An investigation by Sky News stated that at least some of the intelligence gathered by ASIO had been provided by Israeli agencies.

Macdonald commented that up until Albanese’s announcement, he had considered it to be  a ‘no-brainer’ that Mossad (Israel’s external intelligence agency) was responsible. His question invited comments from the panel.

Attack of the Zionists extremists

Two days later, the right-wing media and Zionist Lobby quickly swung into action. Blogsite Israellycool.com was first off the blocks with an attack on Macdonald for being ‘offensive’ and ‘heartless’. The Daily Mail Australia then reported on Macdonald’s question, labelling it ‘wild’ and ‘bizarre’.

In fact, Mossad has often been discussed in mainstream media as being involved in deceptive and covert operations, including the use of false Australian passports in a Dubai operation that killed a Hamas operative. Intelligence agencies have a long record of putting out false information, including supposed ‘credible intelligence’ of Iraq’s possession of weapons of mass destruction that led to the 2003 war in Iraq.

The Australian Jewish Association posted the Daily Mail story online, triggering a torrent of abuse of Macdonald from its followers. Spectator Australia and The Australian followed up with attacks on Macdonald. The latter republished a personal letter by Executive Council of Australian Jewry co-CEO Alex Ryvchin in which he concludes Macdonald should be “disciplined” for causing “great harm” as a result of “taking leave of his senses” and promoting “wild fantasies” and conspiracies.

Three days after the forum, on September 2, three Melbourne members of the AAAHC, Drs Jeremy Goldin, who is a consultant at a St Vincent’s private hospital in Melbourne, psychiatrist Dr Jacqueline Rakov and radiologist Dr Karen Fink sent a complaint to St Vincent’s hospital and the NSW Minister for Health Ryan Park, which was reported by the Australian Jewish News. 

They accused Macdonald of promoting “textbook antisemitic conspiracy tropes” and “spreading poisonous myths” that must be “repudiated without hesitation.” 

“St Vincent’s hospitals have many Jewish patients, staff and community members who would be rightly appalled by Macdonald’s conduct,” the complaint stated. The doctors argued Macdonald’s comments “breached St Vincent’s Health Australia’s Group Code of Conduct, which is grounded in values of compassion, justice, integrity and excellence.”

“Publicly promoting false, divisive, racist conspiracy narratives is incompatible with integrity and justice,” they wrote, adding that his conduct fostered “hostility toward a religious minority.”

Macdonald had not mentioned Jewish or Israeli people.

The complainants demanded Macdonald’s “immediate suspension from all clinical, teaching and research roles, an independent investigation, and if facts are confirmed, termination of his association with St Vincent’s.”

St Vincent’s Hospital reacts

Like all major institutions, St Vincent’s Health Australia has a code of conduct which provides for procedural fairness and the appointment of a person that can determine if there is a sound basis for allegations. As expected, the code focuses on incidents that occur in the workplace.

The AAAHC demanded, “We are fed up with performative responses to racial vilification,” the doctors wrote. “This is not a moment for equivocation or PR euphemisms.”

Instead of complying with its own code, St Vincent’s took the extraordinary step of immediately issuing a statement which prejudged the issue.

“Unequivocally, St Vincent’s does not associate itself with the remarks of the employee” (not named). 

“St Vincent’s rejects antisemitism, racism, bigotry and hate. It has no place in an organisation that was founded to share love and compassion to the most vulnerable through healthcare and other supports.

“Upon his [the employee’s return], St Vincent’s will take appropriate next steps in accordance with our internal policies and procedures.

“More frequent instances of antisemitism in Australia – including in healthcare settings – is a disturbing and upsetting development … St Vincent’s is very conscious – particularly from talking to staff and community members from Jewish backgrounds – that many people are experiencing feelings of unease, fear, and dismay at this phenomenon.

“We want to assure every member of our community – whatever their background and beliefs – that St Vincent’s is a safe harbour from antisemitic or bigoted views.”

St Vincent’s did not explain how it reached the conclusion that anything Macdonald had done amounted to ‘antisemitism, racism, bigotry or hate’, nor did it state who was responsible for the statement.

MWM sent questions to St Vincent’s asking who was responsible for issuing the statement; how it had reached its conclusions; what evidence it had; whether it had considered requirements for natural justice, and whether its statement itself would cause harm. 

St Vincent’s declined to answer any questions. 

A spokesperson for the NSW Minister for Health, Ryan Park, said he had responded to the AAAHC but provided no details of the nature of his response.

Victor Chang Institute pipes in

As recently as July this year, Victor Chang Cardiac Research Institute proudly reposted an ABC interview with Macdonald as an example of its worth and high standards. But this didn’t stop its CEO, Professor Jason Kovacic, from issuing an equally damning statement.

Without naming Macdonald, he alleged that his colleague had,

“caused significant distress amongst our community. We categorically disagree with the remarks in question, which were made by the individual in a personal capacity at a political forum. We consider they are antisemitic and conspiratorial. They are antithetical to our aim of fostering community wellbeing. The Institute condemns antisemitism, racism, and all forms of discrimination.

“Given the ‘gravity’ of the situation, Victor Chang is conducting “a thorough review to understand all aspects of that matter” to “ensure our values and policies are upheld by everyone who works with us.”

The Victor Chang Institute also refused to answer any questions.

Support for MacDonald

Peter Macdonald has plenty of support, including from people who believe that St Vincent’s and Victor Chang Institute’s intemperate responses have caused harm. Personal letters have been written to the CEO of St Vincent’s, including from those whose lives were saved by Macdonald and from donors to St Vincent’s Hospital. 3800 people have signed PJMS’s open letter.

The  Medical Association for the Prevention of War have issued a public letter calling on St Vincent’s and Kovacic to retract their attacks on Macdonald. “Vexatious or unfounded accusations distort our understanding of what anti-Semitism truly is. They have a chilling effect – by threats and intimidation – on the rights to freedom of speech and political opinion, and can leave health advocacy wide open to political influences.”

At the heart of this matter is the issue of freedom of political speech, which the NSW Council for Civil Liberties President, Timothy Roberts, said yesterday must be protected,

“It is in the public’s interest for questions to be asked regarding the trustworthiness of information from the government, including from intelligence agencies. This year alone it has been exposed that the Dural Caravan incident was known to be a criminal hoax from early on, while the NSW Premier used this to inflame fear in the public and push through anti-protest laws. 

“In a democratic country, we are entitled to question and scrutinise the decisions of all states. Even more so, we are entitled to question and scrutinise the decisions of intelligence agencies.”

Rather than doing further harm to one of Australia’s most eminent medical practitioners for exercising his right to political speech, St Vincent’s and the Victor Chang Institute should consider whether, in their scramble to dump on their employee, they are not in breach of the very principles of fairness and integrity on which they claim to base their practice.
