Foreign Affairs Minister Alexander Downer has confirmed a US Embassy official was the outsider who recently saw David Hicks at Guantanamo Bay.

Mr Downer said a media officer from the US Embassy in Canberra saw Mr Hicks a week ago and reported he was in "reasonably good shape".

Mr Hicks's US military lawyer has criticised the visit, but Mr Downer says he does not understand that.

"It seems to me you're damned if you pass information on to people by the Hicks team and you're damned if you don't," he said.

Mr Downer says he has again been assured by the United States that new charges will be laid against David Hicks "in a matter of weeks, not months".
